Clarification Text on the Protection and Processing of Personal Data of Job Candidates

As KAVACIK MEDICAL HEALTH SERVICES AND PRODUCTS TRADE AND INDUSTRY JOINT STOCK COMPANY, we attach the utmost importance to the security of your personal data. With this awareness, we place great importance on processing and protecting the personal data of natural persons who wish to work within our company and who apply for a job, in accordance with Law No. 6698 on the Protection of Personal Data (“Law”), the secondary regulations enacted or to be enacted pursuant to the Law (such as regulations, communiqués, and circulars), and the binding decisions taken or to be taken by the Personal Data Protection Board. With full awareness of this responsibility, and in our capacity as the “Data Controller” as defined in the Law, we process your personal data within the scope of account opening procedures as explained below and within the limits prescribed by the legislation.

1- Information Regarding the Data Controller

Pursuant to the Law, the data controller is: KAVACIK MEDICAL HEALTH SERVICES AND PRODUCTS TRADE AND INDUSTRY JOINT STOCK COMPANY, located at * address.

2- Purposes of Processing Personal Data

Your personal data may be processed by the COMPANY, including the personal data contained in the documents you share or will share during your application such as name, surname, contact information, photograph, and additional personal data that may be requested from you if you proceed to later stages of our candidate evaluation process.

Your personal data may be processed for the following purposes:

  • Conducting recruitment and application processes for employee candidates,
  • Carrying out communication activities,
  • Planning human resources processes,
  • Conducting employment processes.

Your personal data will be processed in compliance with the law, in accordance with the principles of honesty, and in a manner that is relevant, limited, and proportionate to these purposes, within the limits specified in the Law.

3 -Transfer of Personal Data

Your personal data may be processed, within the scope of the purposes stated above, by the employees and managers of the Human Resources Department within the Company, as well as third parties with whom we cooperate and from whom we receive services during employment processes, and with insurance companies, limited to these purposes and based on your explicit consent.

4- Methods and Legal Grounds for Collecting Personal Data

Your personal data are collected by the Human Resources Department through automatic and non-automatic methods, via means such as e-mail, website, paper documents, internal workplace references, and business partners involved in employment processes, in verbal, written, or electronic environments.

Within this scope; personal data that may be included in your CV/job applications, such as name and surname, nationality, place of birth, date of birth, gender, marital status, driver’s license, photograph, education information, military service status certificate for male employees, phone number, e-mail address, personality assessment evaluations conducted to determine your compatibility with our working principles and team, your references, camera recordings for monitoring workplace entry and exit, your suitability for the job, and the reason for rejection in case your job application results negatively, are processed based on the legal grounds set forth in Article 5 paragraph 2 (d-e-f) of the Law, namely that the data has been made public by the data subject and that data processing is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the relevant person.

 

5 - Rights of Data Subjects Within the Scope of the Law

At any time, by applying to the COMPANY;

  • To learn whether your personal data is processed,
  • To request information regarding your personal data if it has been processed,
  • To learn the purpose of processing your personal data and whether they are used in accordance with their purpose,
  • To know the third parties to whom your personal data is transferred domestically or abroad,
  • To request the correction of your personal data if it has been processed incompletely or incorrectly,
  • To request the deletion or destruction of your personal data within the framework of the conditions stipulated in Article 7 of the Law,
  • To request that the transactions carried out pursuant to Article 11 (d) and (e) of the Law be notified to the third parties to whom your personal data has been transferred,
  • To object to the emergence of a result against you by analyzing your processed data exclusively through automated systems,
  • To request compensation for damages in case you suffer damage due to the unlawful processing of your personal data,

you may exercise your rights.

If you would like to obtain more information regarding this matter or about your personal data, you may submit a written application via e-mail to İletişim@medistate.com.tr or to the address Rüzgarlıbahçe Mahallesi Cumhuriyet Cad. No: 24 PK: 34805 Beykoz / İstanbul. Provided that the application is made in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller, the requests included in your application will be concluded within 30 days at the latest, depending on the nature of the request. In the application you will make in order to exercise your rights as the personal data owner, which includes your explanations regarding the right you request to exercise; the matter you request must be clear and understandable, and the subject of the request must be related to yourself. If you are acting on behalf of another person, you must submit a special power of attorney certified by a notary public. According to the Communiqué on the Procedures and Principles of Application to the Data Controller, it is mandatory that applications include name-surname, signature, Turkish ID number, residence or workplace address, e-mail address, phone and fax number, and the subject of the request. Applications that do not include these elements will be rejected by the COMPANY.

 

EXPLICIT CONSENT STATEMENT WITHIN THE SCOPE OF THE LAW NO. 6698 ON THE PROTECTION OF PERSONAL DATA

Within the framework of the information provided to me through the Information Notice on the Protection and Processing of Personal Data of Employee Candidates, I hereby declare that the personal data I have provided, including my name, surname, phone number, e-mail address, home address, photograph, professional experience, educational status, references, and all personal data contained in my curriculum vitae, as well as other personal data not listed here but submitted to the Company due to my job application, have been provided with my own consent. I declare my explicit consent for my personal data to be used, recorded, stored, and transferred by the Company for the purposes stated in the Information Notice, to be transferred to third-party companies from which services are received within the employment processes in which the Company cooperates, and for my information to be shared with companies requesting references in line with reference requests made to your Company on my behalf. I acknowledge and declare that I have learned all my rights regarding the processing and protection of personal data, including my right to request information, and that I have been informed that I may exercise these rights at any time in accordance with the Law by applying to the data controller.
